Michael Masterson at Cover4Insurance has advised all cyclist to check that they have adequate insurance following the recent court case involving Robert Hazeldean (cyclist), and Gemma Brushett (pedestrian). Where the cyclist was sued for compensation after the person, he crashed with at a busy London bridge junction suffered injuries to her front teeth and facial scars as a result of the accident where they both were knocked unconscious.

The pedestrian was apparently staring at her phone as she stepped into the road with a group of people. The court heard that Ms Brushett tried to dart back to a traffic island but the cyclist, who had been travelling at between 10-15 mph, swerved in the same direction and hit her on July 20, 2015. Mr Hazeldean had come through a green traffic light and had tried to catch her attention by sounding his bike horn and shouting.

According to the Evening Standard the cyclist Mr Hazeldean who knocked over Ms Brushett a yoga teacher when she stepped into the road while staring at her phone is facing bankruptcy after being ordered to pay up to £100,000 in compensation and legal fees.

Even though the Judge accepted that Mr Hazeldean is a “calm and reasonable road user” and ruling Ms Brushett (yoga teacher) was equally to blame for the accident and could have been sued herself.

This case could set a precedent for future case so we would advise all cyclist to ensure that they have adequate cover in place that cover for Public Liability and not just theft of the bike.
